The following terms of service ("Terms of Service") govern your access to and use of the Entreprenext website and mobile application, including any content, functionality, and services offered on or through www.entreprenext.com or the Entreprenext mobile application (collectively, the "Site"). These Terms of Service are entered into by and between you and Entreprenext Technologies Pvt. Ltd. ("Entreprenext", "we", "us", or "our").

By accessing or using the Site, signing up for an account, or clicking to accept or agree to the Terms of Service when prompted, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms or the Privacy Policy, please do not access or use the Site or App.

   • By accessing or using the Site, opening an account, signing up to the platform, or clicking to accept or agree to these Terms when this option is presented to you, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Site or the Entreprenext platform.

   • By continuing to access or use the Platform after modifications to these Terms are posted, you agree to be bound by the revised Terms

2. Services

   • Entreprenext provides / plans to provide the following services:

     • Tools and Resources: Access to various curated business tools and resources, both third-party links and self-developed content.

     • Trainer Connect Platform: A platform for connecting with trainers for business purposes.

     • Business Consultant, Coach, and Mentor Connect: Services to connect small business owners with business consultants, coaches, and mentors.

     • Other Services: Any other services related to or impacting the initiation or growth of small businesses or startups. 

     • Additional Terms and Modification of Services: Certain services may be subject to additional terms or require a separate agreement, and the list of services provided is not exhaustive and may be modified or expanded at our discretion.

3. Use of Our Services 

   • Eligibility: You must be at least 18 years old to use our Platform, or the age of majority in your jurisdiction, whichever is higher.

   • Registration: To access certain features of our Platform, you may be required to register and provide certain personal information. You agree to provide accurate, current, and complete information and to update this information to maintain its accuracy.

   • User Responsibilities: You are responsible for your use of the Platform, any content you post, and any consequences thereof. You may use the Entreprenext Platform (Site or App) only in compliance with these Terms and all applicable laws, rules, and regulations.

   • Declaration: By using the Entreprenext Platform (Site or App), you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

   • False Information and Data Protection Measures: Providing false information during registration may result in the suspension or termination of your account, and we employ robust data protection measures to safeguard the personal information you provide during registration.

4. User Conduct

   • You agree not to:

     • Use the Site for any unlawful purpose or in violation of any local, state, national, or international law.

     • Violate or encourage others to violate the rights of third parties, including intellectual property rights.

     • Post, upload, or distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable.

     • Interfere with the operation of the Site or any user’s enjoyment of the Site, including by disrupting networks connected to the Site.

     • Use any automated process to access or use the Site.

   • Violating these conduct rules may result in the suspension or termination of your account, and in severe cases, may lead to legal actions.

5. Intellectual Property

   • Our Content: Except for your user-generated content, all content on the Platform, including texts, graphics, images, music, software, audio, video, and all intellectual property rights related thereto, are our property or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said content, whether in whole or in part, for commercial purposes without our express written permission.

   • Your Content: You retain your rights to any content you submit, post, or display on or through the Platform. By submitting, posting, or displaying content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.

   • Reporting IP Infringements: Users can report intellectual property infringements by contacting us via email at support@entreprenext.com and providing detailed information about the alleged infringement, including any relevant evidence.

   • License Duration: Any license granted to Entreprenext for user-generated content will be valid for the maximum period permitted by applicable law, unless otherwise specified in a separate agreement.

   • The Site contains links to third-party websites and / or resources. These links are provided for your convenience only. Entreprenext does not endorse, and is not responsible for, the content or services on or available from those websites or resources.

   • Disclaimer on Third-Party Sites: Users are advised that any interactions with third-party websites or resources linked on our Platform are at their own risk, and Entreprenext assumes no responsibility for any transactions, content, or damages arising from such interactions.

   • Guidance for Third-Party Transactions: Users should exercise caution and review the terms and conditions and privacy policies of any third-party websites they visit from our Platform.

7. Privacy

   • Our Privacy Policy describes how we handle the information you provide to us when you use our services. By using our Platform, you agree that we can use such data in accordance with our privacy policies.

   • Compliance with Data Protection Laws: These Terms will be promptly updated to reflect any changes in data protection laws and regulations to ensure ongoing compliance.

   • Company Policy Updates: Any amendments to our company policies that affect user data or privacy practices will be incorporated into these Terms in a timely manner.

8. Termination

   • We reserve the right to suspend or terminate your account, or cease providing you with all or part of the Platform services at any time for any reason, including but not limited to: (i) a violation of these Terms, (ii) the creation of a risk or legal exposure for us, or (iii) a determination that the provision of services to you is no longer commercially viable. Users may also choose to terminate their account at any time by following the instructions in the account settings. Upon termination, we will delete the user’s data in accordance with our Privacy Policy.

9. Disclaimers and Limitation of Liability

   • To the fullest extent permitted by law, in no event will Entreprenext, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

   • Accuracy and Reliability of Third-Party Content: Entreprenext makes no representations regarding the accuracy or reliability of third-party content or services linked on our Platform and strongly advises users to conduct their own due diligence.

   • Limitation of Liability: The limitation of liability outlined in these Terms applies to the fullest extent permitted by law, including any state or country-specific exceptions that may apply.

10. User Responsibilities

    • Accuracy of Information: Users are responsible for providing accurate and complete information when creating an account and using the Site.

    • Compliance: Users must comply with all applicable laws and regulations while using the Site.

    • Account Security: Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.

11. Termination

    1. Termination by Entreprenext: We reserve the right to suspend or terminate your account and access to the Site, at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Site, us, or third parties, or for any other reason.

    2. Termination by User: You may terminate your account at any time by following the instructions on the Site. Upon termination, your right to use the Site will immediately cease.

12. Entire Agreement: 

    1. These Terms constitute the entire agreement between you and Entreprenext regarding the use of the Site and supersede any prior or contemporaneous understandings and agreements between you and Entreprenext related to the subject matter hereof.

13. Severability: 

    1. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision will be deemed modified to the extent necessary to make it enforceable, and the remaining provisions of these Terms will remain in full force and effect.

    2. No Waiver Clause: Any failure by Entreprenext to enforce any provision of these Terms does not constitute a waiver of our rights to subsequently enforce such provision or any other provision.

    3. Continuation of Rights: Entreprenext reserves the right to enforce these Terms in full, regardless of any previous leniency shown in enforcement.

14. Other General Terms

    1. Modification: We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Platform. By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised Terms.

    2. Governing Law: These Terms and any action related thereto will be governed by the laws of India, without regard to its conflict of law provisions.

    3. Notice Period for Changes: Users will be provided a notice period of 30 days to review significant changes to the Terms of Service before they take effect.

    4. Notification Method: Changes to the Terms will be communicated to users through email notifications and / or on-site announcements to ensure they are informed in a timely manner
